TERMS AND CONDITIONS
1. Information on how to participate in the Brother Rewards program (“Program”),
how to collect unique codes associated with the Program (“Codes”), how to accumulate
points for redemption (“Points”) and rewards listed or advertised from time to time
in connection with the Program (“Rewards”), including information at
www.brother-rewards.com.au (“Website”), form part of these terms and conditions.
Participation in the Program constitutes acceptance of these terms and conditions.
2. The Program is only open to residents of Australia. Employees of the Promoter,
the Promoter’s associated companies, resellers, Promoter's agencies associated with
the Program are ineligible to participate.
3. The Program opens on 1 September 2010 and finishes on 31 May 2012 (the “Final
Redemption Date”) unless terminated earlier by the Promoter in accordance with these
Terms and Conditions.
4. To participate in the Program
Step 1: Register – – Go to the Website and follow the prompts to enter your
full name, home address, your unique and valid email address and preferred password.
You will receive an email confirming your registration for the Program, together
with your Points account (“Account”) details. Accounts are limited to one per person
and valid email address. If your personal details change, it is your responsibility
to update these in accordance with the instructions on the Website.
Step 2: Enter Codes – Once registered, you are a “Program Participant” and
you may enter Codes into your Account. Each Code deposits the specified number of
Points into your Account. Each Code can only be entered once and into one Account
only. For verification purposes, you must keep your original purchase receipt as
proof of purchase of the relevant Product, for a period of 6 months after you have
entered the Code and provide it to the Promoter on request. If you fail to provide
proof of purchase as requested, the Promoter may invalidate the Codes entered. From
time to time, the Promoter may conduct a promotion or issue an offer that results
in an entitlement to a direct credit of Points into your Account, in which case
the Promoter will deposit the specified number of Points directly into your Account.
Points are valid and may be redeemed for up to 6 months from the date on which they
are entered or otherwise credited to your Account, provided that they are redeemed
before the Final Redemption Date
Step 3: Redeem – log into your Account and follow the prompts to redeem your
Points for any of the Rewards listed on the Website or otherwise advertised. See
clause 6 for Reward limitations. All redemptions must be made by the Final Redemption
Date. Any Points not redeemed by the Final Redemption Date are void.
5. To obtain Codes and Points:
5.1. Purchase any specially marked eligible Brother product (“Product”). Eligible
Product is TN-2025 Value Triple Pack, TN-2150 Value Triple Pack, TN-240 Colour Value
Pack or TN-155 Colour Value Pack. Peel back the promotional sticker where indicated
to reveal the Code on the TN-2025 Value Triple Pack or TN-2150 Value Triple Pack,
or look inside the sleeve to obtain the code for the TN-240 Colour Value Pack or
TN-155 Colour Value Pack. Please take care: the Promoter accepts no liability for
Codes that have been revealed or removed prior to purchase and it is your responsibility
to check prior to purchase that the Product label has not been tampered with such
that the Code has been previously revealed or removed; or
Watch out for special promotions advertised from time to time that allow Program
Participants to obtain Codes or earn Points and follow the instructions given.

6. A list of the Rewards available from time to time, including the number of Points
required for each Reward and any conditions or limitations, (“Catalogue”) is displayed
on the Website. Rewards may from time to time include products, services, vouchers,
entry into competitions, donations to charity and other benefits. Redemption of
Points for any Reward constitutes your acceptance of the conditions and limitations
set out in the Catalogue for that Reward. Redemption of Points for participation
in any competition constitutes your acceptance of the terms and conditions of that
competition.
7. Rewards may be removed from the Catalogue without notice. Access to Rewards may
be limited in any way by the Promoter, including access for a limited time only,
up to a specified quantity only (per Program Participant or across the whole Program)
or for certain Program Participants only.
8. Rewards redeemed from an Account will be awarded to the holder of that Account,
subject to these terms and conditions.
9. If any Reward in the Catalogue is unavailable despite the Promoter’s reasonable
endeavours to procure it within Australia, without limiting clause 7, the Promoter
reserves the right to substitute a different item of equal or greater value or to
credit the Program Participant’s Account with the number of Points that were required
for redemption of the Reward.
10. Rewards are not transferable and cannot be taken as cash. Reward values are
correct as at the time of publication, but no responsibility is accepted for any
variation in the value of any Rewards.
11. Rewards are subject to the terms and conditions of individual Reward providers.
12. A maximum of 10 Codes are permitted to be entered in a 30 day period, per Account.
In the event you enter 10 Codes within a 30 day period you may be requested to provide
proof of purchase and original codes.
13. The Promoter accepts no liability for any tax implications that may arise from
the redemption of any Reward. Independent tax advice should be sought by Program
Participants.
14. Subject to the operation of clause 27, the Promoter may amend the Program in
any way, in whole or in part (including making changes to the Products, the number
of Points required to redeem a Reward and the period of time for which a Point is
valid) at any time, provided that 1 month’s notice is given if the change lessens
the rights of a Product purchaser or a Program Participant. Notice may be given
via the Website.
15. You must keep your password confidential. You are fully responsible for all
activities that occur under your Account using your password. Only 3 incorrect log-in
attempts to your Account are permitted. Users will be locked out of their Account
for 24 hours after this limit is reached.
16. Each entered Code obtained from a Product must be associated with a separate
Product purchase.
17. Codes must not be sold or otherwise traded.
18. Points do not constitute property, do not have a cash value and do not entitle
the Program Participant to a vested right or interest. Unused Points are void if
not redeemed for Rewards by the Final Redemption Date.
19. Any Account registration, Code entry or Reward redemption not complying with
these terms and conditions is invalid. The Promoter reserves the right to verify
the validity of all Account registrations, Code entries and Reward redemptions,
to refuse to register any person or disqualify any Program Participant for tampering
with the registration, Code entry or Reward redemption process or breaching these
terms and conditions (including submitting a Code associated with a Product that
has not been purchased). A disqualified Program Participant forfeits any rights
under the Program.
20. Any attempt to deliberately damage the Website or the information on it or to
otherwise undermine the legitimate operation of the Program is a breach of these
terms and conditions and may be a criminal offence. Attempting to gain access to
another person’s Account or information, trying to obtain or generate Codes other
than in accordance with these terms and conditions or trying to obtain or generate
another person’s Account information is a breach of these terms and conditions and
may be a criminal offence.
21. The Promoter is not liable for any loss or damage, including direct or consequential
loss or damage, or personal injury suffered during the course of participating in
the Program, or of accepting or using a Reward, except for liability that cannot
be excluded by law.
22. Program Participants should look to the manufacturer of products and provider
of services received as Rewards for all warranties. However, these terms and conditions
do not exclude or limit the application of any statutory provision where to do so
would contravene that statute or cause any part of these terms and conditions to
be void.
23. All personal information will be held by the Promoter in accordance with the
Promoter’s Privacy Policy, which can be accessed by visiting www.brother.com.au.
Unless you indicate at the time of registration that you do not wish to receive
information about the Program, including in relation to its operation, the Rewards
available from time to time and other offers and benefits available to you as a
Program Participant, your email and home address may be used to send you such information.
Each communication will explain how you can unsubscribe from receiving such further
information in the future.
24. All decisions made by the Promoter are final and no correspondence will be entered
into.
25. The Promoter reserves the right at any time during the Program to require a
Program Participant to provide proof of age and identity in a form determined by
the Promoter.
26. The Promoter will endeavour to process valid registrations, Code entries and
Reward redemptions and to distribute Rewards to the Program Participant within 28
days of redemption, unless otherwise specified in relation to a specific Reward.
27. If for any reason the Program is not capable of running as planned, whether
caused by infection by computer virus, mobile phone failure, line drop out, bugs,
tampering, unauthorised intervention, fraud, technical failures or any other cause
beyond the control of the Promoter which corrupt or affect the administration, security,
fairness or integrity of the Program, the Promoter reserves the right to immediately,
without notice, modify, adapt, suspend or terminate the Program, as appropriate.
28. Registrations, Code entries and Reward redemptions are deemed to be received
at the time of receipt into the Promoter’s database. The Promoter is not responsible
for any loss related to the receipt by it of incorrect, inaccurate or incomplete
information caused by a Program Participant or occurring during transmission. The
Promoter is not responsible for any problems or technical malfunction of any phone,
phone or computer network, or lines, servers, or phone or internet providers, traffic
congestion on any phone or computer network, or any combination of them, including
the delay or non-delivery of any email or any injury or damage to Program Participants’
or any other person’s handset or computer related to participation or sending or
receiving of any communication or any materials in the Program.
29. Any cost related to accessing the Website is your responsibility and is dependent
on the internet service provider used. The use of any automated software or any
other mechanical or electronic means that allows any person to automatically enter
Codes or claim multiple Rewards repeatedly is prohibited and will render all Codes
or Reward redemptions submitted by that person invalid.
30. It is your responsibility to ensure you are familiar with these Terms and Conditions,
including any updates made pursuant to clauses 14 or 27. Any updated Terms and Conditions
can be viewed at
www.brother-rewards.com.au.
31. The Promoter is Brother International (Aust.) Pty Ltd (ABN 17 001 393 835) of
Level 3, Building A, 11 Talavera Road, Macquarie Park NSW 2113.
